1. Background and acceptance of the General Terms and Conditions of Sale.
These general terms and conditions (hereinafter also "General Terms and Conditions") regulate the offer by the Valleogra Distribuzione of Fochesato Luigi (henceforth also "Valleogra Distribuzione") of products on www.furordivino.com e www.furordivino.it (henceforth also "Website"). The General Conditions must be accepted by the User when registering on the Site in order to take advantage of the offers made therein and to proceed to purchase products.
Valleogra Distribuzione reserves the right to change all or part of the General Conditions at any time, notifying Users through the Site with at least 30 days' notice, if the way in which the products and services offered are used is changed. Users are therefore required to periodically consult this page so that they are always informed about the conditions applied. 2. Ownership of the Site - Type of offers,

3. Site Registration
The Site is intended only for Users who are 18 years of age or older. Navigation and use of the services offered within the Site are made accessible upon registration procedure.
Registration is free of charge. Users registering on the Site will have to provide some personal information and follow all the steps from the procedure (henceforth also "Registration Complete"). At the time of Complete registration, the User will be asked to choose one Username and a Password, which the User undertakes not to transfer even temporarily to third parties and to keep with due care, diligence, and secrecy under his own responsibility, constituting these credentials the only means to identify the User and to validate his accesses to the offers. Full Registration is required to proceed with the purchase of products and to access summary information related to the activities performed by the User on the site (also "Account").
Partial Registration to the Site (henceforth also "Partial Registration"), by entering only the user's email address. Partial Registration allows the user only to receive the newsletter, and also not to proceed to purchase products and/or services, or otherwise carry out other transactions on the Site.
4. Conditions of the offer
Subject of the offers of Valleogra Distribuzione Is the purchase of goods at the prices listed on the Site.

However, the User is always informed of the amount of shipping costs before completing the purchase process and making the payment.
The images accompanying the information sheets of a product or an offer may not be perfectly representative of its characteristics but differ in color, size, and accessory products featured in the picture. All purchase support information is intended as mere general information material, and therefore not referable to the actual features of an individual offer.
The validity of offers may be subject to quantity or time limitations, after which, they may no longer be available. The validity date and/or available quantity of the offers are posted on the Site so that the User can become aware of them. Valleogra Distribuzione may change the duration or quantity of an offer at any time at its discretion, provided that it will follow up on orders placed during the term of a particular offer. Where provided on the Site, Valleogra Distribuzione may donate a percentage of the total amount of the order placed by the User to charity, allocating it to the entity made known on the Platform from time to time in accordance with the regulations adopted by the latter regarding charitable donations. By way of example only, Valleogra Distribuzione may donate such amounts to research organizations, hospital companies, NGOs etc. In such cases, the User will be able to view the amount that will be donated to charity before completing the order, on the shopping cart summary page.
5. Purchase procedure and payment method
Having acknowledged the terms of the offer, the User may conclude the purchase by following the procedure on the Site.
Before the purchase is finalized, a summary will be displayed showing the unit cost of the selected item and the total, in case of purchase of several quantities of the same item or different items. The cost of any shipping, delivery or postal charges may be fixed or variable, calculated according to the weight of the goods, the number of items selected and/or the destination address indicated by the User during the purchase process. Shipping costs may also be included in the sale price of some items or be free of charge if the total amount of the order exceeds a certain value or as a result of specific promotion. However, the User is always informed of the amount of shipping costs before concluding the purchase procedure and making the payment.Once the purchase is concluded, the User must proceed with the payment, which will be made against Valleogra Distribuzione, both in the case of Direct Sale and Intermediate Sale.
In the case of Intermediate Sale Valleogra Distribuzione will receive payment in the name and on behalf of the Partner, thus always remaining extraneous to the relationship between the Partner and the User. Unless otherwise specified on the item detail page, it should still be understood that the products are sold directly by Valleogra Distribuzione.
Following successful payment, the User will receive a confirmation email containing information about the purchased offer.The email will also contain a reference to these General Terms and Conditions. The confirmation will contain a summary of the delivery and billing address. The goods are shipped within the timeframe indicated in the order confirmation. Delivery times are also indicated before concluding the purchase procedure in the shopping cart summary or on the product page. This information is indicative and does not represent a certain date, as it is not always possible to foresee possible delays due to the courier responsible for delivery to the Customer or other causes due to third parties or force majeure not attributable to Valleogra Distribuzione.In case of time offers (flash-deal), the goods may be shipped to the User after the expiration of the same. In the absence of the confirmation email, the purchase cannot be considered validly concluded. The accepted methods of payment, unless otherwise specified or agreed with the User, are: Credit and prepaid cards from the Visa, Mastercard, Maestro, Postepay, American Express, Discover (Diners Club International and Pulse) circuits, with PayPal account, Apple Pay and bank transfer. Valleogra Distribuzione may, in some or all cases and at its total discretion, offer the alternative mode of payment by means of mark (cash on delivery of goods).
Unless otherwise specified in the terms of the offer, the amounts due will be charged upon confirmation of payment. In the case of bank transfer, when confirming the order, the bank details (IBAN), the amount of the transfer and the order number will be indicated. Payment by bank transfer must be made within the terms that may be specified and in any case no later than 2 days after order confirmation, a deadline beyond which it may not be possible to guarantee the fulfillment of the goods: in this case Valleogra Distribuzione will re-credit the sender, at no additional cost and by bank transfer, any payment received after the deadline.

6. Security in transactions

7. Coupon
Valleogra Distribuzione can issue discount codes (henceforth also "Coupon") that the User can use when purchasing products. The Coupons are issued in the form of an alphanumeric code and their value (in euros) is established in its sole discretion by Valleogra Distribuzione. The Coupon may be entered by the User in the appropriate "Coupon" field at the time he or she proceeds to place the order. The Coupon so entered will be deducted automatically, and before payment, from the total amount of the order excluding any shipping charges. Coupons with percentage discounts are not applied to products already on promotion. Coupons are generally usable by the user for a limited period of time, after which they will no longer be usable. The Coupon may be subject to a minimum spending amount under which its use will not be possible. Unless otherwise specified, the Coupon is personal and tied to the User's Account and may be used for a single purchase, after which it will be automatically invalidated.
Coupons are not cumulative. Coupons may not be sold, given away and/or transferred to third parties except with the express permission of Valleogra Distribuzione.
Valleogra Distribuzione reserves the right to cancel any previously issued Coupons, even before expiration, without having to justify the reason and without the right to indemnity or compensation. 8. Shipping and delivery

Shipment of the goods shall be made within any maximum time specified in the conditions of the offer and, for timed offers (flash-deal), may run from the end of the same. The goods are shipped within the time specified in the order confirmation. Delivery times may also be indicated before concluding the purchase procedure in the cart summary or on the product page. This information is indicative and does not represent a certain date, as it is not always possible to foresee possible delays due to the courier responsible for delivery to the Customer.
In any case Valleogra Distribuzione, unless otherwise specified on the product sheet, undertakes to deliver the goods within 15 working days from the date of the order and on average deliveries take place in 48/72 working hours throughout Italy with the exception of the islands where the average delivery time is 72/96 working hours. In the remote event that the goods become unavailable for any reason after receipt of the order, a refund of any payment received will be issued, at no cost to the User.
The User may be informed by email when the product is shipped from Valleogra Distribuzione, whether it is a Direct Sale or an Intermediate Sale, in the latter case at the time the Partner communicates to Valleogra Distribuzione the successful shipment.
The User will be notified, if available, the name of the courier and the tracking code of the shipment (Waybill or "Tracking"), through which it will be possible to follow its status. This information, if available, will also be visible within the User Account.
Valleogra Distribuzione cannot guarantee that multiple products purchased at the same time will be delivered in a single shipment, nor that any different shipments will arrive at their destination at the same time. In fact, the offers may refer to products supplied by different Partners and/or may not come from a single centralized warehouse. It is not possible to guarantee an exact delivery date or time as this depends on the courier company, the destination address, and the delivery party.
Valleogra Distribuzione therefore cannot be held liable for any direct or indirect consequences arising from these timelines. Delivery of what is ordered is intended, unless otherwise specified during the purchase process, to the street level.
In the case of shipping bottles, Valleogra Distribuzione uses packaging patented and approved by the courier, designed to ensure the integrity of the product. In any case, upon delivery of the goods by the courier, the User will be required to verify that the packaging is intact, undamaged, or otherwise altered, even in the sealing materials (adhesive tape or strapping) or that there is no leakage of liquid. Any damage to the packaging and / or the product must be immediately contested by the User, placing a written reserve of control (and specifying the reason for the reserve, e.g. "punctured packaging", "crushed packaging", etc.) on the courier's delivery document. Once this document has been signed, the User may no longer make any objection about the characteristics of what has been delivered.
Any problems with the physical integrity, correspondence or completeness of the products received should be reported within 3 days of delivery by emailing: info@furordivino.comor to the Partner's email address, if any, indicated in the order confirmation and within the User Account.
In case of non-delivery of the goods within the specified time, the User will be required to give notice to Valleogra Distribuzione, who will check with the Partner and/or directly with the courier, the status of the shipment and any anomaly. Following a shipment anomaly (e.g. package lost or destroyed in transit), Valleogra Distribuzione shall, in the case of a Direct Sale or request, in the case of a Drop Shipment or Intermediate Sale, a reshipment of the product, subject to its availability in the Partner's warehouse or at the Partner's premises, without further expense or aggravation to the user, or, refund the order in full in the case of a Direct Sale or arrange for the Partner (directly or through Valleogra Distribuzione) proceed to refund in case of Intermediate Sale.
9. Product conformity warranty
VALLEOGRA DISTRIBUTIONoperates diligently and in absolute good faith in selecting suppliers and Partners, verifying their actual suitability to supply the products in the quantities and according to the characteristics described in the purchase offers, it being understood that Valleogra Distribuzione cannot be responsible for personal injury resulting from any violation by the producers. In any case, Valleogra Distribuzione cannot guarantee the completeness neither of the content of the information provided by the Supplier or Partner, nor of the perfect correspondence of what is described in the product sheet or offer with the product actually delivered, as well as the legitimacy of the use by the Supplier or Partner of the images, videos and distinctive signs.
The User is also aware that the images used on the proposals may sometimes only be indicative of the product and may not always accurately represent the product delivered. In the case of an Intermediate Sale, and therefore products supplied directly by a Partner, the Partner will be solely responsible for the conformity of the products under warranty. Any complaints should be sent directly to the Partner by email to the address contained in the purchase confirmation and for information also to info@furordivino.com.
The Partner will indicate how the goods can be checked, repaired or replaced, or authorize Valleogra Distribuzione To issue a refund to the User. In the case of Direct Sale, Valleogra Distribuzione Will be directly responsible for the conformity of products under warranty. Valleogra Distribuzione will indicate a suitable repair center for the verification and repair of the goods under warranty or, once the anomaly has been directly verified, the subsequent repair or replacement or make a refund by re-crediting the title originally used for payment or issuing a Coupon in the amount equal to the amount of the product purchased. In any case, the legal guarantee is reserved for consumers or individuals who have made a purchase on Valleogra Distribuzione For purposes unrelated to any entrepreneurial, commercial, craft or professional activity.
10. Withdrawal
A User who requests a service for purposes unrelated to his or her professional activity has the right to withdraw from the purchase contract concluded with Valleogra Distribuzione or with the Partner without any penalty and without having to provide any reason, within 14 working days pursuant to and for the purposes of Article 52 paragraph 1 of the Consumer Code, which runs from the day of receipt of the product purchased on Valleogra Distribuzione.
Withdrawal may be exercised by the Customer, pursuant to Article 54 paragraph 1 of the Consumer Code, by using the withdrawal form in Annex I, Part B of the Consumer Code or by submitting any other explicit statement of his or her decision to withdraw from the contract, to be sent either by letter a/r, to Valleogra Distribuzione of Fochesato Luigi, Via Melegnano, 1 IT 36015 Schio(VI) or by email at. info@furordivino.comor by Fax to +39 055 0935599 or, in the case of an Intermediate Sale, also to the email address of the Partner indicated on the purchase confirmation page and also present in the User Account, also making aware of Valleogra Distribuzione.
The letter a/r, email or Fax must contain the indication of the product and the order number. The burden of proof regarding the proper exercise of the right of withdrawal, in accordance with the above procedure, is on the User.
Following the proper exercise of withdrawal, unless Valleogra Distribuzione or the Partner does not collect the good directly, the User shall have the burden of returning the good without undue delay and in any case within 14 days from the date on which the User notified Valleogra Distribuzioneor to the Partner its decision to withdraw from the contract in accordance with Art. 54, c. 4. The User shall affix, on the packaging, in a visible manner the document received from Valleogra Distribuzione following the notice of withdrawal mentioned above, in which the shipping address and order details necessary to identify the return at its destination are already indicated. The User is advised to include a copy of this document inside the packaging as well, in order to avoid its loss or inability to identify the return once it reaches the warehouse.
The related costs of shipping the goods will be borne by the User, unless Valleogra Distribuzionefailed to inform the same in this regard when concluding the contract, in accordance with Article 57 paragraph 1 of the Consumer Code.
The goods must, however, be stored, handled and inspected with normal diligence and returned intact, complete in all their parts, accompanied by all accessories and illustration sheets, identification tags and original labels, where present, still attached to the goods and intact and not tampered with, as well as perfectly suitable for their intended use and free of signs of wear or dirt.
As provided for in Article 57 paragraph 2 of the Consumer Code, the User is responsible for any decrease in value resulting from handling the good other than what is necessary to establish the nature, characteristics and functioning of the good. In such a case Valleogra Distribuzione, upon written notice to be sent to the User within 5 working days of receipt of the good, may reduce the amount of the refund by reason of such decrease in value, providing the same, if the refund has already been paid, the bank details for the payment of the amount due by the User due to the decrease in value of the good.
Valleogra Distribuzione may refuse to accept a withdrawal for food products that have been consumed even partially. Pursuant to Article 59 of the aforementioned Consumer Code, goods that are custom-made or personalized or which, by their nature, cannot be returned or are subject to rapid alteration or deterioration are excluded from the possibility of withdrawal.
11. Right of Withdrawal Exceptions
It is in any case understood that, with reference to the provision of services, the right of withdrawal cannot be exercised by the User after the complete supply of the products by Valleogra Distribuzione where the supply itself has begun with the express agreement of the User and the User has agreed to forfeit the right of withdrawal following the full performance of the service by Valleogra Distribuzione.
In any case, pursuant to Article 59 of the Consumer Code, goods that are custom-made or personalized or which, by their nature, cannot be returned or are subject to rapid alteration or deterioration are excluded from the possibility of withdrawal.
12. Refunds
The possible disbursement of the sums by way of reimbursement by Valleogra Distribuzione, if due, will take place in accordance with art.56 paragraph 1 Consumer Code as soon as possible, and in any case no later than 14 days from the date on which the event giving rise to the reimbursement occurred and in the case of withdrawal, from the day on which it became aware of the relevant exercise by the User.
Valleogra Distribuzione will make the refund using the same means of payment used by the User for the initial transaction, unless expressly agreed otherwise with the User and provided that the User does not incur any costs as a result of using the different means of payment.
If the User has expressly chosen a different type of delivery that involves higher delivery costs than those associated with the standard delivery offered by Valleogra Distribuzione ("Additional Costs"), the latter shall not be required to reimburse the relevant Additional Costs.It is understood that, except in cases where Valleogra Distribuzione Has decided to collect the goods directly, Valleogra Distribuzione may withhold the refund until it has received the goods or until the User has demonstrated that it has returned the goods, whichever situation occurs first.
13. Responsibilities of Valleogra Distribuzione
Valleogra Distribuzione shall not be liable for damages that may result from the use of the Site such as computer viruses, omissions, service interruptions and software failures, including to the User's computer equipment, that prevent or delay the provision of services if these are due to external causes, force majeure and/or third parties beyond the control of the owner.
Valleogra Distribuzione will only be responsible for any defects or deformities found in the Direct Sale, while under no circumstances will it be responsible for any defects or deformities found in the Intermediate Sale, for which the Partner alone will be responsible to the User. Consequently, the User is informed that in such situations he/she will have to address his/her complaints and take action exclusively against the Partner.
In any case Valleogra Distribuzione and/or the Partner shall in no event be held responsible for delays or defects or discrepancies dependent on events beyond their reasonable control such as, but not limited to:
- force majeure events;
- events dependent on the acts of third parties such as the interruption or malfunction of telecommunications operators' services and/or power lines, or acts or omissions by carriers or shippers.
14. Industrial and intellectual property
Subject to the restriction on the use of the distinctive marks of the Partners, Valleogra Distribuzione is the owner of all rights relating to the graphic and conceptual content of the Site, as well as the distinctive signs proper in it made visible. it is therefore forbidden to reproduce, even partially, the content and graphics of the Site, as well as the distinctive signs in it made visible. Valleogra Distribuzione is also the owner of the technological platform for managing the Site.
15. Privacy
Personal data are collected and processed for the purpose of responding to User requests. Valleogra Distribuzione guarantees its users that it operates in compliance with the regulations on the processing of personal data, governed by the Privacy Code set forth in Legislative Decree No. 196/2003. The privacy policy is to be considered an integral and substantial part of these General Conditions and is accessible in the Privacy section of the Site. 18. Conciliation Procedure. Applicable law and place of jurisdiction
These General Conditions shall be governed in all APPEARANCE by Italian law.
For any dispute concerning the interpretation, execution and/or termination of the contract between the User and Valleogra Distribuzione, in the case of a Direct Sale, or between the User and the Partner in the case of an Intermediate Sale, the Parties acknowledge that the Court of the User's place of residence or domicile shall have jurisdiction, if the User is to be considered a "consumer" under the relevant laws in force.
If, on the other hand, the User is a professional, in the case of Direct Sale the Court of Vicenza will have jurisdiction, while in the case of Intermediate Sale the Court of the Partner's place of domicile will have jurisdiction.
19. Alternative dispute resolution
(so called Alternative Dispute Resolution / On Line Dispute Resolution)
and Netcomm Joint Conciliation
Valleogra Distribuzione informs pursuant to Article 141-sexies of the Consumer Code the consumer User that if he/she has submitted to Valleogra Distribuzione a complaint, but was not satisfied with the outcome of the complaint or did not receive a response within 30 days, may initiate the conciliation procedure.
